Terms of Service

By commissioning me, you have read and agreed to these terms.

Wait time can vary from 1 month to 2-3 months. If given a deadline, will finish by deadline ASAP. I usually will try to inform you immediately of any immediate complications. I have chronic wrist pain and am always working through it. If something occurs and wait time increases, I will inform you as soon as I can.I have limited commission slots available and I will be closing commissions February 10th ( January 2023). I will always inform you when I start your commission but you're always welcome to ask what the estimated wait time will be. Please remember to be patient. I am currently dealing with a backlog of work so things are prioritized by given deadlines, if no deadline is given, I will work on commissions as soon as I have the availability to do so.Life is unexpected and sometimes it can take between 2-3 months if something unexpected happens, I will always try to inform you immediately when something has come up and it may take way longer than usual. If you need a commission by a specific date, please let me know in DMs or by email, or in the instructions.All commissions are personal use only! Personal use means you can use for profile pictures, backgrounds and banners etc. You're always welcome to post the commissions you receive, I just ask that you tag me. THE ARTIST ◉ I retain all rights to the finished commission and preliminary materials produced during the working process, which include but is not limited to: distribution & reproduction (feature in artbook with client's permission), self-promotion, display on public sites & portfolio as commission samples.◉ I have right to decline your commission request for personal reasons.◉ I have right to alter my Terms of Service at any time. New rules will not apply retroactively and won't influence orders started on older terms.THE CLIENT ◉ Client must be above 18 years old to order a commission.◉ Commissions are for personal use only: gift, wallpaper, personal prints, use on social medias with credit to the artist (@NiGHTDYE_ or profile link).◉ Do not trace, edit, resell or make profit from the commission. Cropping the artwork to post online is OK.◉ Do not use any part of the commission for non-fungible tokens (NFT), blockchain, crypto currency, AI image generators and future inventions of these technologies.PAYMENT◉ 100% upfront via PayPal invoice for commission under $300 (USD)◉ Payment Plan is optional for commission above $300: 50% upfront and 50% after sketch approval.◉ All invoices are due within 7 days, unless there are other agreements. Invoices past the due date will be cancelled along with the commission associated to it.REFUND POLICY◉ Full refund = The net amount I received after Paypal transaction fee deduction.◉ Full refund can be requested via email before I start working on the commission.◉ Strictly no refund once I've started working on the sketch or after delivery of the final artwork. Please make revisions during the earlier stages to prevent any dissatisfaction.◉ When a Payment Plan is applied, it is possible to cancel at delivery of the sketch, the 50% upfront payment will not be refunded.◉ Do not file chargebacks under any circumstances. Please always contact me first to resolve any issue. DEADLINE & WORKFLOW◉ I will work following the order and deadlines on Commission List. If for any reason I need to extend the deadline, I will tell you as soon as possible. If you have a specific deadline in mind, please provide it in the Ko-fi commission details.◉ Process is divided into 3 stages: sketch → line art and color/shading draft → finished artwork.◉ Time between sketch and finished artwork is around 1 to 4 weeks, no longer than 4 weeks if nothing occurs suddenly. All clients will be alerted if work cannot be completed within 1 to 3 months of when the order is placed.◉ The finished artwork will be delivered via email or google drive link in .jpg image format. This does not include the working files (.psd, .csp). File will be of highest resolution (300dpi) and include a small watermark.REVISIONS◉ Maximum of 3 revisions (3 rounds) in the sketch stage, 2 revisions in lineart and color stage, free of charge. Further revisions will cost additional fee.◉ Free revisions are limited to what was agreed upon in Commission Form and minor changes. Major revisions outside the scope of the Form which require redrawing (pose & outfit change, add background, etc) will cost additional fee. Sometimes I may offer changes for the composition that I think will fit your requirement, the final decisions are yours and my suggestions are all free.◉ Please give feedback within 3 days. On day 3, I will send a reminder in case you miss my previous email. If there's still no contact after 3 days, I will start the next stage without waiting for approval to not cause delay on the Commission List.
